responsibility to maintain a printed copy of your filled form for your records. The submitted form
will serve as a legally binding document between you and Marlboro Auto Repair.

Exceptions: This arbitration agreement does not prevent you or Marlboro Auto Repair from seeking injunctive relief in a court of law to prevent or address unauthorized use of intellectual property rights, unauthorized access to computer systems, or any other unauthorized activities that may cause irreparable harm.
4) Loaner Car Terms & Policies:
a) Eligibility Criteria: To be eligible for a loaner car,
customers must be at least 21 years old, possess a valid driver's license, and
either have a full-coverage insurance policy or agree to pay for any necessary
repairs or replacement of the loaner car. Customers may obtain a loaner car only
after submitting our online vehicle repair service form or paper form, and when
their vehicle is in the shop for repairs.
b) Fuel Policy: Loaner cars must be returned with
the same fuel level as at the time of pick-up. If the car is returned with less
fuel, a refueling charge of $5 per gallon will be applied along with a $20
convenience fee.
c) Mileage Restrictions: The daily mileage limit for the
loaner car is 100 miles. Additional mileage is charged at a rate of $0.30 per
mile. The loaner car must not be used for long-distance travel outside the
state without prior authorization or used for any commercial purposes.
d) Late Return Policy: Loaner cars must be returned by the
agreed-upon time. If you anticipate a delay, please inform us in advance,
otherwise, a late fee will be charged.
e) Smoking/Pets Policy: Smoking inside the loaner car is
strictly prohibited. Pets are only allowed in a secured carrier. Violation of
this policy will result in a $150 detailing/cleaning fee.
f) Contact Information: For any queries, extensions, or
concerns regarding the loaner car, please contact us. We also ask that you keep
us informed of any changes in the return time.
g) Return Condition Report: Upon receiving the loaner car, a
thorough inspection will be conducted in the presence of our representative.
h) Personal Belongings: Please ensure all personal
belongings are removed upon returning the vehicle. The company is not
responsible for items left in the car and cannot guarantee their return.
i) Traffic Violations & Tolls: The customer is responsible for all
traffic violations, parking tickets, and toll charges incurred during the
loaner car's usage.
j) Insurance and Liability: As a customer, you are obligated to provide valid proof of insurance that covers the use of rental or loaner vehicles. In instances of accidents or damage to the loaner car, your insurance coverage will be primarily responsible. If your insurance does not provide coverage, you will be personally liable for the repair costs, which will be treated as out-of-pocket expenses.
In cases where Marlboro Auto Repair incurs costs for repairs, or covers a total loss of the loaner vehicle, reimbursement will be sought from you or your insurance company prior to the release of your vehicle. This applies irrespective of whether your own vehicle repairs have been fully paid for.
Full restitution not only includes the costs directly related to repair or replacement of the loaner vehicle, but it may also involve costs associated with acquiring a replacement vehicle of similar specifications and market value, in cases where the loaner car has been totaled. The intent of this policy is to restore Marlboro Auto Repair to its original operational status, as it was prior to the incident involving the loaner car.
k) Accident Reporting: In the event of an accident,
customers should contact the local authorities (if necessary) and file a police
report. Customers must also inform our office within 24 hours and provide a
copy of the police report.
l) Total Loss: In the event the loaner car, subject
to a finance agreement, is totaled, the customer and/or their insurance company
must provide full restitution. This includes the car's market value; the
remaining balance on the finance agreement; and all additional costs associated
with acquiring a replacement vehicle, including (but not limited to) down
payments of $5000.00 and any related fees. This policy ensures that we can
replace the totaled vehicle with one of similar value and specifications
without incurring additional costs.
m) Medical Expenses: Any medical expenses incurred due to an accident involving the loaner car will be the sole responsibility of the customer or their insurance company. This includes medical expenses for the customer themselves as well as for any other individuals involved in the accident.
n) Acknowledgment and Agreement: By accepting the keys to the loaner
car, the customer acknowledges and agrees to adhere to these policies. Also, by
submitting our online form, customers agree to adhere to the terms and
conditions enumerated in the website’s footer, including those concerning the
loaner car. Violation of these policies may result in additional fees,
compensation for damages, and termination of loaner car privileges.
5) Car Rental
Policies:
a) Eligibility Criteria: Renters must be at least 21 years
old, possess a valid driver's license, and either have a full-coverage
insurance policy or purchase the optional insurance provided by our rental
service.
b) Rental Rates: Daily rental rates are subject to
vehicle type and availability. For the most current rates, please call our
staff or refer to the rental form when filling it out.
c) Fuel Policy: Rental cars must be returned with
the same fuel level as at the time of pick-up. If the car is returned with less
fuel, a refueling charge will be applied at current market rates, along with a
$20 convenience fee.
d) Mileage Restrictions: Depending on the type of rental
agreement, mileage limits may apply. If your agreement includes mileage limits,
additional mileage is charged at a rate of $0.30 per mile.
e) Return Policy: Rental cars must be returned by the
agreed-upon time to the agreed location. If you anticipate a delay, please
inform us in advance, otherwise, a late fee will be charged.
f) Smoking/Pets Policy: Smoking inside the rental car is
strictly prohibited. Pets are allowed only in a secured carrier. Violation of
this policy will result in a detailing/cleaning fee.
g) Damage to Vehicle: The renter is responsible for any
damage to the vehicle that occurs during the rental period, beyond normal wear
and tear.
h) Traffic Violations & Tolls: The renter is responsible for all
traffic violations, parking tickets, and toll charges incurred during the
rental period.
i) Insurance and Liability: Renters must provide proof of
insurance that covers rental vehicles. In the event of an accident or damage to
the rental car, the renter's insurance will be billed. If the renter is not
sufficiently insured, they will be liable for all repair costs. Renters may opt to use our insurance policy at an additional cost.
j) Accident Reporting: In the event of an accident, renters
should contact the local authorities (if necessary) and file a police report.
Renters must also inform our office within 24 hours and provide a copy of the
police report.
k) Total Loss: In the event the rental car is
totaled, the renter and/or their insurance company is responsible for the full
value of the car, as well as any lost rental income during the replacement
period.
l) Acknowledgment and Agreement: By accepting the keys to the rental
car, the renter acknowledges and agrees to adhere to these policies. Violation
of these policies may result in additional fees, compensation for damages, and
could lead to being barred from future rentals.
6) Changes to the Terms of Use
We reserve the right to modify or update these Terms
of Use at any time without prior notice. It is your responsibility to review
these terms periodically for any changes. By continuing to use the Marlboro
Auto Repair website after any modifications, you agree to be bound by the
revised terms.
7) Governing Law
These Terms of Use shall be governed by and construed
in accordance with the laws of Prince George’s County, without regard to its
conflict of laws principles.
8) Arbitration Agreement and Class Action Waiver
"Arbitration Agreement: By using the Marlboro Auto Repair website or obtaining services from Marlboro Auto Repair, you agree that any disputes, controversies, or claims arising out of or in connection with your use of the Marlboro Auto Repair website or services, whether relating to contractual or tortious liability, shall be resolved by binding arbitration, and not by court litigation. This includes both disputes that are currently in existence and disputes that may arise in the future. This agreement to arbitrate is to be interpreted broadly and encompasses all disputes of any nature whatsoever, including but not limited to issues of quality of service, repair disputes, billing disputes, and any other issues that might arise.
Waiver of Class Action Rights: By agreeing to these terms, you hereby irrevocably waive any right you may have to join claims with those of others or participate as a member of a class of claimants with respect to any claim submitted to arbitration. Your rights will be determined by a neutral arbitrator and not a judge or jury.
Choice of Law: This agreement and any dispute arising hereunder shall be governed and interpreted by the laws of Prince George's County, without regard to its conflict of laws principles.
By accepting these terms, you acknowledge and affirm that you are willingly and knowingly waiving any right you may have to a trial by jury in respect of any litigation arising out of, under or in connection with these terms and conditions, your use of the Marlboro Auto Repair website, or any course of conduct, course of dealing, statements, whether oral or written, or actions of either party."
